On October 22, 2024, Kyle J. Keller was featured in the Law360 article “Pa. Casino Must Face Suit Over Hand Sanitizer Slip and Fall.” Kyle and Aron Minkoff recently appealed an Order granting summary judgment to Mt. Airy Casino in Monroe County against our client and dismissing her case. After a year of an appeals process, the Pennsylvania Superior Court granted our appeal and reversed the Trial Court’s decision, paving the way for our client to get her day in court with a jury trial. “The client is pleased with the court’s decision,” Kyle said in the article.
He was also quoted as saying that “The Superior Court’s well-reasoned decision will have a positive, rippling effect for not only our clients, but for plaintiffs throughout the Commonwealth of Pennsylvania as their right to a jury trial will not be stripped away from them simply because they cannot identify with certainty the dangerous condition which caused their injuries. At the end of the day, in the commonwealth of Pennsylvania, a defendant should not be able to escape liability when that defendant created a dangerous condition on its property and failed to take precautions to prevent foreseeable harm to guests of that property.”
